The Fair Labor Standards Act (FLSA) requires that employers pay eligible non-exempt employees an overtime premium of at least 1.5 times their regular rate of pay for hours worked over 40 in a workweek.

On May 18, 2016, the U.S. Department of Labor (DOL) released a revision to the federal overtime regulations that could extend overtime protections to far more employees.

This Final Rule was scheduled to take effect on December 1, 2016; however, a federal court judge issued a preliminary injunction to temporarily block the DOL from implementing and enforcing its Final Overtime Rule nationally, pending further review by the court.
