Updated: January 3, 2017

The Fair Labor Standards Act (FLSA) requires that employers pay eligible non-exempt employees an overtime premium of at least 1.5 times their regular rate of pay for hours worked over 40 in a workweek.

On May 18, 2016, the U.S. Department of Labor (DOL) released a revision to the federal overtime regulations that could extend overtime protections to far more employees.

This Final Rule was scheduled to take effect on December 1, 2016; however, a federal court judge issued a preliminary injunction to temporarily block the DOL from implementing and enforcing its Final Overtime Rule nationally, pending further review by the court. This guide includes the latest information on the situation, an overview of the FLSA, how your company could be impacted by the new rule if it comes to fruition, and what you can do to prepare.
