Form 1099-NEC: A Filing Guide for SMBs Who Hire Independent Contractors

Formulario 1099 NEC

If your business paid an independent contractor for services in 2026, you likely need to file Form 1099-NEC. There's more to track this year, too. The One Big Beautiful Bill Act raised the reporting threshold from $600 to $2,000, split Box 1 into four sub-boxes, and moved excess golden parachute payments onto the form. The good news is that most contractor payments only involve Box 1a.

Three mistakes trip up business owners most often: mixing up Form 1099-NEC with 1099-MISC, missing the filing deadline, and filing with a wrong or missing contractor TIN, which can trigger B-notices and backup withholding.

This guide walks through who must file, the 2026 threshold and deadlines, box-by-box instructions, how to file, state rules, penalties, and how to fix a mistake after the fact.

What Is Form 1099-NEC?

Form 1099-NEC is the IRS form you use to report nonemployee compensation, meaning payments of $2,000 or more your business made to someone who isn't an employee for their services. Reintroduced for tax year 2020, it moved these payments off Form 1099-MISC and set a January 31 deadline.

On their end, contractors and gig workers report the income on Schedule C and calculate self-employment tax on Schedule SE.

1099-NEC vs. 1099-MISC: What's the Difference?

The 1099-NEC vs. 1099-MISC question can get confusing. In short, you use Form 1099-NEC for paying people for their work. You use Form 1099-MISC for almost everything else, such as rent, royalties, prizes and awards, medical and health care payments, and other income.

Attorney payments are a good example of the difference.1099-NEC vs. 1099-MISC. Legal fees go on Form 1099-NEC, while gross settlement proceeds go on Form 1099-MISC.

Who Must File a 1099-NEC?

You need to file 1099-NECwhen all four of these conditions are met:

  • The payment was made in the course of your trade or business.
  • You paid the payee $2,000 or more during the calendar year.
  • The payment was for services, including related parts and materials.
  • The payee is an individual, partnership, estate, or LLC taxed as a partnership or disregarded entity.

A few common situations fall outside the rule:

  • Corporations. Payments to C and S corporations generally don't require a 1099-NEC. Payments for legal services are an exception.
  • Employees. Wages go on Form W-2 and follow the rules in the employer’s guide to payroll taxes. Get the 1099 vs. W-2 decision right for each worker (which is ultimately a classification decision), and the right form follows.
  • Card and app payments. The processor reports credit card, debit card, and third-party network payments on Form 1099-K, so you don't.

If someone was both an employee and contractor during the year, report wages on the W-2 and contractor payments on the 1099-NEC.

2026 Reporting Threshold and What Counts as Nonemployee Compensation

For payments made on or after January 1, 2026, the 1099-NEC threshold is $2,000 under Section 70433 of the One Big Beautiful Bill Act. Starting in 2027, that amount will be adjusted for inflation.

The $2,000 threshold applies to all payments you make to the same contractor during the year. For example, three $700 payments add up to $2,100 and require a 1099-NEC.

Nonemployee compensation includes professional fees, commissions, contract labor, prizes and awards for services, cash tips and overtime paid to nonemployees, and excess golden parachute payments. Personal payments, rent, royalties, and payments to most corporations don't count.

Note that there's one exception to the $2,000 threshold. If you withheld federal income tax from a contractor under the backup withholding rules, you must file a 1099-NEC for that contractor regardless of the amount you paid.

When Is the Deadline to File Form 1099-NEC

Both copies are due January 31: Copy A goes to the IRS, and Copy B goes to the contractor. If January 31 falls on a weekend or federal holiday, the deadline moves to the next business day. For 2026 payments, that means Monday, February 1, 2027.

Unlike most other 1099s, Form 1099-NEC doesn't get an automatic 30-day extension. You must request one with Form 8809 and have a qualifying reason, such as a natural disaster, death, or serious illness of the person responsible for filing.

State filing deadlines can differ, so check the rules for each state where you need to file.

What Information You Need to Complete a 1099-NEC

Before you complete a 1099-NEC, gather:

  • Payer information. Your legal business name, address, and EIN.
  • Recipient information. The contractor's legal name, address, and TIN, such as an SSN, EIN, or ITIN. You collect this on Form W-9.
  • Payment details. Total nonemployee compensation, cash tips, Treasury Tipped Occupation Code (TTOC), overtime, excess golden parachute payments, federal backup withholding, and any state withholding.

Run every W-9 through the IRS TIN Matching program before filing. A name or TIN mismatch can trigger a B-notice and mandatory 24% backup withholding on future payments.

1099-NEC Instructions: Box-by-Box Breakdown (2026 Revision)

Most contractors only need Box 1a. Boxes 1b through 1d are new for 2026 and apply only if you paid a nonemployee cash tips or qualified overtime.

Here's what goes in each box on the December 2026 revision of Form 1099-NEC:

  • Box 1a, Nonemployee compensation. Enter total compensation of $2,000 or more paid for services during the year.
  • Box 1b, Cash tips. New for 2026. Report cash tips separately here, even though they're already included in Box 1a, to support the No Tax on Tips deduction.
  • Box 1c, Treasury Tipped Occupation Code (TTOC). New for 2026. Enter up to two occupation codes. If 000 is the only code, the Box 1b tips don't qualify for the deduction. Paychex also explains the codes in its No Tax on Overtime and Tips webinar.
  • Box 1d, Overtime compensation. New for 2026. Report overtime separately here, even though it's already included in Box 1a, to support the No Tax on Overtime deduction.
  • Box 2, Direct sales of $5,000 or more. Check this box if you sold $5,000 or more in consumer products to the recipient for resale on a buy-sell, deposit-commission, or similar basis.
  • Box 3, Excess golden parachute payments. New to Form 1099-NEC for 2026 after moving from Form 1099-MISC. Report payments to a disqualified individual in a change-in-control transaction that exceed the base amount. Most small businesses won't use this box.
  • Box 4, Federal income tax withheld. Enter any 24% backup withholding required because the payee didn't provide a valid TIN or the IRS told you to withhold.
  • Boxes 5-7, State information. Optional fields for state tax withheld, the state or payer's state number, and state income.

How To File Form 1099-NEC

Filing Form 1099-NEC comes down to five steps:

  • Collect Form W-9. Get a completed W-9 from every contractor, ideally before you make the first payment. Build this into your process from the start. Our guide on how to pay 1099 workers walks through the setup.
  • Check the $2,000 threshold. Add up each contractor’s payments for the year and identify those who reached $2,000.
  • Complete each copy. Copy A goes to the IRS, Copy 1 to the state if required, Copy B to the contractor, Copy 2 for the contractor’s state return, and Copy C stays with your records.
  • Choose how to file. If you file 10 or more information returns of any type (all your 1099s, W-2s, and similar forms combined), you must file electronically. File through the IRS Information Returns Intake System (IRIS). You need a Transmitter Control Code (TCC) to use it, so request one well before the deadline. If you file fewer than 10 returns, you can file on paper and include Form 1096.
  • Send Copy B by January 31. It's the same deadline as the IRS copy, and the contractor needs it to file their own return.

State Filing Requirements for 1099-NEC

Don't assume your federal 1099-NEC filing covers the state requirements. The Combined Federal/State Filing (CF/SF) Program sends filing data to participating states, but some states still require you to file directly.

State thresholds can differ, too. California has adopted the $2,000 federal threshold for 2026, while Mississippi and Wisconsin remain at $600. Check each state's tax agency every filing season to confirm its current requirements.

Penalties for Late or Incorrect 1099-NEC Filings

For 2026 payments reported in 2027, 1099-NEC penalties apply per form, and the amount increases the longer you wait to file.

When you filePenalty per form
Within 30 days of the deadline$60
More than 30 days late, but by August 1$130
After August 1 or not at all$340
Intentional disregard$690 or 10% of the amount that should have been reported, whichever is greater

Missing the contractor copy can cost you, too, because the IRS can assess a separate penalty for Copy B, so one missing form can be penalized twice. Smaller businesses may get some relief through lower annual penalty caps if your average gross receipts are under $5 million.

How To Correct a Filed 1099-NEC

The IRS uses two correction methods for 1099 errors, called Type 1 and Type 2. Which one you use depends on what needs to be fixed.

  • Type 1 errors. For a wrong amount, code, or checkbox, submit one corrected 1099-NEC with the “CORRECTED” box checked. If the form should not have been filed, enter zero for all dollar amounts.
  • Type 2 errors. For a wrong or missing recipient TIN, wrong recipient name, or wrong form type, first submit a form matching the original information, with “CORRECTED” checked and all dollar amounts set to zero. Then submit a new form with the correct information and “CORRECTED” left unchecked.

Send the recipient a corrected Copy B, too. File corrections through IRIS or, if filing on paper, include a new Form 1096. On a paper correction, don’t check the VOID box, or the IRS won’t enter your correction.

Best Practices for 1099-NEC Compliance

A little work throughout the year can make 1099 filing much easier when January arrives. Pair these with our year-end tax-saving tips and build them into your contractor payment process:

  • Get Form W-9 before the first payment. Collect the contractor’s name and TIN up front so you aren't chasing missing information at year-end.
  • Check every W-9 with IRS TIN Matching. Catching a mismatch early can help you avoid B-notices and mandatory 24% backup withholding.
  • Track payments by contractor. Set up accounts payable so you can see when a contractor reaches the $2,000 annual threshold.
  • Separate card and third-party payments. Keep these payments separate from amounts you may need to report on Form 1099-NEC.
  • Reconcile before filing. Compare your 1099-NEC totals with the contractor expenses in your general ledger and resolve any differences.
  • Keep contractor records. Save Forms 1099-NEC for three years (or four if backup withholding applies) and Forms W-9 for four years. Retain supporting payment records with your tax records.
  • Automate the filing process where possible. A payroll or tax services provider can prepare and e-file forms and deliver Copy B, reducing manual data-entry errors.
