Paychex HR PEO Referral Program Terms & Conditions

If you refer a client to Paychex HR PEO, as a thank-you we’ll pay you or your business a referral incentive based on the size of the referred client. We will pay $500 per PEO referral for clients with 5-20 employees. For clients with more than 20 employees, we will pay $25 per employee, up to a maximum of $10,000 per client. To refer a company, use this form.

The referral incentive is subject to the following conditions:

Payment is based on the number of full- and part-time employees enrolled and active on the referred client’s payroll thirty (30) days after the Paychex HR PEO service agreement effective date. For qualifying referrals of clients with 5-20 employees, we will pay a referral incentive of $500. For qualifying referrals of clients with more than 20 employees, we will pay a referral incentive of $25 per employee, up to a maximum of $10,000 per referred client. Referral eligibility includes full- and part-time employees enrolled and active under additional clients who run a first payroll within 12 months after the original referred client’s Paychex HR PEO service agreement effective date, as long as those additional clients have the same FEIN as the original referred client. For such referrals, the referral incentive is based on the combined employee count for the original referred client and those additional clients, with a maximum referral incentive of $10,000. We will only pay the referral incentive to you if: there are at least 5 covered employees; you refer the account via the form above; you are the first person to refer the account to us (we will not pay more than one referral incentive per referred client) and you provide us the information we request in connection with the referral; the account becomes active on our Paychex HR PEO service within six months of the first date the referral was received; and only after the client has been effective on our PEO service and in good standing for 30 days.

If the business you referred becomes a Paychex client (and not a Paychex HR PEO client), we will pay you a referral incentive of $500 if the business has at least 5 full-time and part-time employees enrolled and active on the account’s payroll thirty (30) days after the service agreement effective date through a Paychex entity other than a Paychex PEO entity. We will pay you as an independent contractor, not an employee. You are solely responsible for any taxes incurred as a result of our paying the referral incentive.

By making a referral via the link/form above, by accepting a referral incentive, and as a condition of our paying a referral incentive, you agree to the conditions listed here and you certify that: you are over the age of 18 (if you are an individual); you are lawfully able to receive the referral incentive; you will not receive any consideration (such as a commission) in connection with Paychex HR PEO’s relationship with the referred client; you are not an officer, director, shareholder, or fiduciary of the referred client; you are not employed by Paychex, Inc. or any of its subsidiaries if you are an individual; and if you are an organization less than 25% of your ultimate beneficial ownership or control is employed by Paychex, Inc. or any of its subsidiaries. We will only pay referral incentives to persons within the United States and will not pay referral incentives if prohibited by law. You cannot assign the ability to receive a referral incentive.

We retain the right in our sole discretion to at any time without notice or consideration establish, modify, discontinue, apply, and interpret the conditions applicable to referral incentives, including without limitation determining whether a referral incentive is payable, the amount of referral incentive payable, who if anyone is credited with a referral, and whether the conditions applicable to the referral incentive are met.
